By accessing or engaging with WOW Marketing Agency (“the Agency”), clients agree to these Terms & Conditions. These govern all services, including branding, graphic design, packaging design, website design, e-commerce development, digital marketing, and photography services.

1. Services Offered

1.1 Branding

• Logo design, typography, color palettes, and full brand identity development.

• Brand strategy, visual guidelines, and marketing collateral (business cards, brochures, print materials).

• Branding Photography to visually represent the brand identity across all platforms.

1.2 Design

• Graphic design for digital and print, including social media assets, advertising, packaging, and promotional materials.

• Motion graphics, multimedia, and campaign visuals.

1.3 Website & E-commerce Design

• Custom website design, responsive layouts, UI/UX optimization.

• E-commerce website development with online store functionality, payment gateways, and product catalog management.

• Website updates, maintenance, and ongoing support per agreed scope.

1.4 Photography Services

• Product Photography for e-commerce, catalogs, packaging, and marketing campaigns.

• Personal Branding Photography for entrepreneurs, executives, and professionals.

• Photography sessions include pre-shoot planning, styling guidance, and post-production editing.

1.5 Packaging Design

• Visual layouts, mockups, and print-ready files for SKUs.

• Compliance guidance provided; final legal responsibility rests with the client.

2. Project Management & Communication

All projects include reasonable project management, administration, and client communication, including emails, virtual meetings, coordination, and feedback review.
Extended communication or consultations beyond standard scope will be billed at R1,250 per hour.

3. Quotation Requests & Project Briefs

• All requests for quotations must be accompanied by a full project brief, detailing project objectives, scope, deliverables, timelines, and any reference materials.

• WOW Marketing Agency cannot provide accurate quotes without a complete brief.

• If the client initiates more than three email exchanges related to the quotation or project clarification before submitting a full brief, a communication fee of R500 will be applied.

• The communication fee is payable before any formal quotation is issued.

4. Project Timelines (Working Days)

*Timelines depend on shoot complexity, location, and post-production requirements.

Timelines are estimates starting from the date of cleared deposit payment. Delays caused by the client may extend delivery.

5. Project Acceptance

Work begins only after signed acceptance of the estimate or quotation or a formal order, constituting agreement to these Terms & Conditions.

6. Fees & Payment Terms

• Deposit: 60% non-refundable deposit due on project acceptance. Work will not commence until received.

• Balance: Payable at milestones or upon project completion.

• Payment Method: Electronic Transfer only.

• Late Payment: Accounts unpaid over 30 days incur 10% monthly interest.

• Rush Fees: Services requested with shorter turnaround than quoted incur R500/hour, if time is available.

• Additional Work: Extra services outside agreed scope will be quoted separately.

7. Revisions & Feedback

• Project fees include a reasonable number of revisions to refine deliverables.

• Clients must provide consolidated feedback; fragmented feedback may be billed at R850/hour.

• Feedback should be provided within 3–5 working days of draft delivery. Delays may result in default approval of drafts.

8. Change of Creative Direction

Significant changes to approved concepts, branding, style, photography style, or website functionality are treated as a new project phase and may incur additional charges.

9. Client Responsibilities

Clients must provide accurate content, approvals, and assets in a timely manner.
Projects delayed by client deliverables over 10 business days will invoke the Pause Clause: work will be placed on hold and rescheduled based on current workload.

10. Ownership, Copyright & Licensing

• WOW Marketing Agency retains copyright of all work, including copy, concepts, proofs, illustrations, and photographs, until full payment.

• Logos and fully paid photography are transferred to the client after full payment.

• Materials supplied by clients must be legally owned or licensed; the client indemnifies the Agency against copyright claims.

• Agency may showcase work in portfolio, social media, and promotional materials unless an NDA is in place.

• Designs and photographs are licensed for single-use unless otherwise agreed in writing.

11. Project Completion

• Projects are considered complete upon client sign-off.

• Additional services (printing, hosting, multimedia production, photography post-production) are separate projects.

• Website projects include one set of minor changes at no extra cost within 14 days of review.

• Photography projects include one round of minor post-production adjustments included in the fee.

12. Off-Site Website Development

• Temporary domains incur R350 monthly hosting/admin fees.

• Projects exceeding 3 months due to non-payment may result in cancellation of the temporary domain.

• Clients are responsible for migration and hosting configuration after delivery.

13. Cancellation & Termination

• Retainer or project services: 1 calendar month written notice.

• Terminating a retainer: 2 months written notice.

• Cancellation after work has started: client is billed for work completed.

14. Confidentiality

All client materials and communications are treated as confidential, unless otherwise agreed.

15. Limitation of Liability

Agency services are delivered with professional care but the Agency is not liable for indirect, incidental, or consequential losses, including business interruptions or lost revenue.
Any claim is limited to the fees paid for the relevant project.

16. Rights of Refusal

The Agency may refuse content deemed immoral, offensive, obscene, or illegal, and may remove infringing material without liability.

17. Governing Law

These Terms & Conditions are governed by South African law. Any disputes fall under South African jurisdiction.

18. Acceptance

By signing an estimate, quotation, order, or engaging our services, clients accept these Terms & Conditions in full.
